He's about to say that he wishes he had been, but in a brief moment of wisdom he opts not to. He doesn't place much hope in the idea of being released on trial given his behaviour so far and the fact that it'll almost certainly be a kangaroo court, but he may as well not tell his malicious intentions to a complete stranger.

"Nay, that would be another man, Jon Simms. He was one of the 'honoured', but now he's been sentenced to death, for invasive use of magic against the High Mage."

Though he withheld some of his ill intent, the sneer he says that with does sort of imply it.
